TERMS & CONDITIONS

GENERAL INFORMATION

Before booking a Dance Service, Clients should read these Terms and Conditions carefully. If Clients are unable to agree with the Terms and Conditions, they must not Book or attend the Dance Services. If, however, the Client agrees to the Terms and Conditions unconditionally, they may Book and attend the Dance Services subject always to these Terms and Conditions. Booking or attending Dance Services shall indicate the Client’s acceptance of the Terms and Conditions.

Live 4 Dancing may amend these Terms and Conditions at any time by posting the amended Terms and Conditions on the Site. The version of the Terms and Conditions that applies to the Dance Services shall always be the version in force at the time the Dance Services were Booked.

BOOKINGS FOR GROUP CLASSES

Upon enrolment the Client is required to complete a Direct Debit mandate form. The Client’s bank account will be debited the termly fee three times a year on 1st September (Term 1), 1st January (Term 2), 1st April (Term 3). An invoice reminder for each term’s Direct Debit payment will be emailed to the Client four weeks before the end of each term. 

Once the Direct Debit payment for any of the terms is made, it is non refundable and non transferable. To discontinue the Direct Debit for any term, Live 4 Dancing needs to be notified in writing by the last day of the previous term. For example, if the Client is enrolled in Term 1 (e.g. 3rd September – 9th December) but for any reason the Client is unable to continue for Term 2, the Client needs to notify Live 4 Dancing in writing by 9th December. 

It is the Client’s responsibility to check that the account details provided are up to date and to inform Live 4 Dancing of any changes to avoid the late payment processing fee. Rejected Direct Debit payments incur a £20 late processing fee. The late processing fee will be added to the Client’s invoice. Failure to pay the late processing fee will result in discontinuing the classes with Live 4 Dancing. 

No refunds are given for classes missed during the term, unless in extenuating circumstances. No refunds are given for cancellations due to adverse weather conditions e.g. severe snow

Examination fees, additional show rehearsals and tickets to any of Live 4 Dancing’s events and performances incur an additional fee. 

 

PRIVATE LESSONS AND PACKAGES

Private lessons with any Live 4 Dancing dance instructor are arranged and booked in advance via online payment or a bank transfer. We do not accept cash payments and cheques on the day of the lesson. To secure the Client’s booking(s), payments need to be made in full at least 5 (five) working days (Mon-Fri excl. Bank holidays) prior to the Client’s requested date(s). Payments made less than 5 (five) working days (Mon-Fri excl Bank holidays) prior to the Client’s requested date(s) will be transferred to the following week. 

Due to the individual nature of the booking Live 4 Dancing requires a minimum of 5 (five) working days (Mon-Fri excl. Bank holidays) notice in order to transfer a private lesson with the studio and the designated instructor. Provided that enough notice is given, Live 4 Dancing will change your booking subject to availability of the instructor and studio space and will charge for any costs of the initial booking, e.g booking a studio space. If changes are required to be made less than the required notice prior to the date set for the lesson, the Client will be charged the full fee of the lesson plus the studio hire fee where applicable.

Paid fees for either one-off private lessons or block bookings are non-refundable neither partially nor in full and it is the Client’s responsibility to book all sessions at the times provided as available for the designated instructor and the studio space.

Arriving late for a scheduled private lesson will result in reducing your session in accordance with that time.

DANCE WORKSHOPS

Bookings for Dance Workshops should be made with as much notice as possible and with a minimum of ten (10) working days’ notice to allow securing a venue and a tutor for Live 4 Dancing’s or the Client’s selected date. Bookings are confirmed upon receipt of full payment due not later than ten (10) working days before the date of the Dance Workshop.

DRESS CODE

Clients must abide to the dress code of Live 4 Dancing as outlined on the website and are expected to attend the classes/ courses/ private lessons/ dance workshops in appropriate Ballroom & Latin dance shoes.

SAFETY

Clients must leave the studio on time. Clients aged 14 and under should be collected on time and have a nominated adult on site 10 minutes before the end of their class, private lesson, dance workshop. Live 4 Dancing requests that the Client notify Live 4 Dancing for alternative leaving or collection arrangements. Please be aware that Live 4 Dancing is under no obligation to enquire about leaving or collection arrangements. Live 4 Dancing is NOT responsible for Clients before and after classes, private lessons, dance workshops.

Clients aged 7 years and under must have a parent or nominated adult on site in case they require the toilet. Live 4 Dancing’s dance instructors cannot accompany Clients aged 7 years and under to the toilet. Clients aged 7 years and under who attend Kids classes, private lessons, dance workshops should bring a bottle of water with them and go to the toilet before the start of their class, private lesson, dance workshop. Live 4 Dancing will not allow Clients aged 7 years and under to leave the room during classes, private lessons, dance workshops.

MISSED CLASSES AND COURSES

If a Client is unable to attend a Class or Course for any reason it is unlikely that Live 4 Dancing will be able to offer an alternative session. If Live 4 Dancing are able to offer an alternative session and the Client chooses not to accept the alternative that is offered the Client is NOT entitled to a refund. If the Client is aware that they will miss any sessions in advance of the start of a Course, Live 4 Dancing requests that the Client notify Live 4 Dancing at the time of Booking and we will endeavour to provide an alternative session. Please be aware that Live 4 Dancing is under no obligation to offer alternative or replacement sessions. If a Client misses a class for 3 weeks in a row and does not inform Live 4 Dancing of the reason, then this place will be opened up as a space, and filled immediately.

VARIATIONS TO BOOKINGS

Clients should be aware that they are considered as committed once they have made a Booking for a particular Dance Service, on a particular date. In order to operate the Dance Services effectively, Live 4 Dancing relies on the commitment of its Clients to uphold their part of the agreement according to these Terms and Conditions. If a Client should need to change or amend a Booking it may have consequences for the business operation and therefore Live 4 Dancing is under no obligation to provide alternative Dance Services should the Client be unable to attend whatever the circumstances.

CANCELLATIONS AND TRANSFERS 

Once Booked and paid for, all Dance Services are non-refundable and non-transferable. 

Live 4 Dancing requires a minimum number of Client Bookings for holding each individual Course. If that minimum number is not achieved by the day after the deadline for booking has expired, Live 4 Dancing reserves the right to cancel the Course or Term of Classes and in this instance will provide a full refund or offer an alternative Course to attend. No refunds will be provided for class cancellations due to adverse weather conditions e.g. severe snow.

VARIATIONS TO SCHEDULED COURSES AND TERM OF CLASSES

On some rare occasions it may be necessary to make alterations to the start date, time, teacher or venue locations of our classes/ courses in order to operate our sessions effectively. All Clients will be notified of any such changes as soon as it is reasonably possible. Any such change(s) shall not constitute a breach of contract and shall not give the Client the right to terminate the agreement.

If Live 4 Dancing are required to change the venue for a particular class due to circumstances beyond our control then we ask the Clients to be reasonable in accepting an alternative venue.

Live 4 Dancing will use reasonable endeavours to ensure that the venue shall be the venue indicated on the Site, but where this is not possible, Live 4 Dancing reserves the right to procure the use of other venue(s), provided that Live 4 Dancing shall give the Client notice of any such change(s) as soon as it is reasonably possible. Any such change(s) shall not constitute a breach of contract and shall not give the Client the right to terminate the agreement.

Live 4 Dancing will use reasonable endeavours to ensure that any individually named teacher(s) shall provide the relevant classes/courses, but where this is not possible, Live 4 Dancing reserves the right to procure the services of suitable alternative teacher(s), provided that Live 4 Dancing shall give the Clients notice of any such change(s) as soon as is reasonably possible. Any such change(s) shall not constitute a breach of contract and shall not give the Client the right to terminate the agreement.

CODE OF CONDUCT

In order to maintain the high standards of our Dance Services Live 4 Dancing reserves the right to refuse admission or participation to any Client who is deemed to be acting inappropriately. This includes behaviour that displays actual or perceived conflict of interest or behaviour that hinders the learning of others. Live 4 Dancing expects all Clients to be polite and well mannered towards other Clients and their Live 4 Dancing dance instructors at all times. If a Client is excluded for unacceptable behaviour they will not be entitled to a refund.

INJURY WAIVER

By agreeing to these terms and conditions the Client hereby waives, releases and discourages all claims they may have against Live 4 Dancing for injuries of any manner from participation in the Dance Services unless they are a direct result of Live 4 Dancing negligence. The Client is obliged to seek medical advice before carrying out any exercise.

If the Client is late for class, then Live 4 Dancing reserves the right to refuse admittance, as the Client could risk injury if he/she has missed part of the warm up. The Client will not be entitled to a refund in such cases.

It is the Client’s responsibility to report any changes to personal details i.e. health, medication, address and contact details, to Live 4 Dancing.

RECORDING & PHOTOGRAPHY

Recording and photography by Clients during any of Live 4 Dancing’s group classes are strictly prohibited. Live 4 Dancing obtains parental photo/ video written consent for the purposes of promoting Live 4 Dancing’s dance services only.

DATA PROTECTION AND PRIVACY

Live 4 Dancing is committed to protecting the privacy and confidentiality of its Site users and Clients. Live 4 Dancing’s privacy notice applies to the use and processing of personal data collected and used by Live 4 Dancing, in accordance with the requirements of the General Data Protection Regulation 2018 (GDPR). It is very important that the information Live 4 Dancing holds about its Clients is accurate and up to date. It is the Client’s responsibility to inform Live 4 Dancing know of any changes in personal information by emailing info@live4dancing.co.uk

GOVERNING LAW

These Terms and Conditions and every agreement for the provision of Dance Services shall be governed in all respects by English law as if the contract was wholly entered into and wholly performed within England. The parties hereby submit to the exclusive jurisdiction of the English court.

Defined Terms:

Client: An individual who purchases and/ or attends Dance Services.

Live 4 Dancing: The trading name for Live 4 Dancing Ballroom & Latin Dance Academy.

Dance Services: Services organised or supplied by Live 4 Dancing. This includes (but is not limited to) dance classes, dance courses, drop-in classes, trial sessions, private lessons and dance workshops.

Terms and Conditions: The Conditions that govern the sale and supply of Dance Services by Live 4 Dancing to you.

Booking (includes any capitalised division): A Client’s order or acceptance of an offer for Dance Services.

Site: The website www.live4dancing.co.uk

Course: A dance programme consisting of more than one dance class/session

Term of Classes: A dance programme consisting of more than one dance class/ session, over the period of 3 to 4 months

Trial Class: A single, one-off dance class/session that could also form part of a Course/Term of Classes

Drop-in Sessions: A single, dance class/session

Private Lessons: A bespoke dance class/session that is requested, scheduled and shaped according to an individual’s Client’s request

Packages: A series of dance classes/ sessions that are requested, scheduled and shaped according to an individual’s Client’s request

Dance Workshops: A dance class/session that is requested, scheduled and customised for groups by Live 4 Dancing or a Client.
